These terms are an agreement between you and Makao (operated by Dennis Muthui) ("we") for using Makao. By creating an account you accept them and our Privacy policy.

What Makao is

We provide a platform that connects hosts who list places to stay with guests who want to book them. The stay itself is an agreement between the host and the guest. We are not the owner or manager of listed places and don't guarantee any listing, host or guest.

Accounts

• You must be 18 or over and give true details, including an M-Pesa number that is yours.
• Keep your password private. You are responsible for activity on your account.
• We may suspend accounts that break these terms or put others at risk.

Hosts

• Listings must be accurate, with real photos of the actual place. You must have the right to let it out.
• You are responsible for any licences, permits, taxes and building or landlord approvals your place needs.
• Your place must be safe and as described. Honour confirmed bookings. If you cancel a confirmed booking, the guest gets a full refund.
• You pay us a commission on each confirmed booking, taken from your payout. The current rate is shown in your host dashboard and applies to bookings made after any change.
• Payouts are sent to your M-Pesa number after the guest checks in, as set out on the Fees page.

Guests

• You pay the nightly price, any cleaning fee and our service fee through M-Pesa. A booking is confirmed when payment succeeds.
• Follow the house rules, keep to the number of guests booked, and leave the place in good order. You may be responsible for damage you cause.
• Cancellations and refunds follow the policy on the Help page.

Reviews

Only guests who stayed can review, and reviews must be honest and respectful. We may remove reviews that are abusive, false or break the law.

What you must not do

• Post false, misleading or illegal listings, or use the platform for anything illegal.
• Take bookings or payments off the platform to avoid fees.
• Attack, scrape or try to break into the service, or use other people's accounts.

Liability

We take care to run the platform well, but we provide it as is. To the extent the law allows, we are not responsible for what happens during a stay, for the conduct of hosts and guests, or for losses we could not reasonably have prevented. Nothing in these terms limits liability that cannot be limited by law, including your rights as a consumer in Kenya.

Changes, ending, and law

We may update these terms and will tell you in the app about material changes. You can delete your account at any time from your Account page. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction. Contact: [email protected].
